RERA Agent Registration

Register as a property agent with the state real estate authority before you market or broker projects.

Anyone who acts as an intermediary in the sale or purchase of a plot, apartment or building in a registered real estate project must be registered as an agent with the state real estate regulatory authority. It applies to individual brokers as much as to firms.

Registration is not optional and the penalty for acting without it is substantial — a daily penalty for the period of the contravention, which can reach a percentage of the cost of the property involved.

What an unregistered agent cannot do

  • Facilitate the sale or purchase of any unit in a registered project
  • Market or advertise a registered project
  • Receive brokerage or commission on such a transaction
  • Have their name lawfully appear in project marketing material

Obligations that come with registration

  • Quote the registration number in every advertisement and communication
  • Maintain books of account and records of every transaction facilitated
  • Not make any false statement about a project, orally or in writing
  • Provide the allottee access to the project information the promoter has filed
  • Not involve yourself in any unfair trade practice
  • Facilitate the buyer’s access to documents at the time of booking

Renewal and training

Registration is granted for a fixed period, commonly five years, and must be renewed before expiry. Several states now also require agents to complete a training and certification programme before registration or renewal.

Maharashtra has been among the more active states on this, so the current requirement should be confirmed at the time of application rather than assumed from an earlier one.

The commercial reality

Beyond the legal requirement, promoters increasingly refuse to pay brokerage to unregistered agents, because doing so exposes them under the Act.

Registration has become a condition of getting paid rather than merely a condition of operating lawfully.

The Act is directed at the sale and purchase of units in registered projects. Pure rental brokerage generally falls outside it, though the position is worth confirming for your specific activity.
