A notice from the Employees’ Provident Fund Organisation typically follows an inspection, a complaint from an employee, or a data mismatch between what you have filed and what the department expects from your establishment.
These notices carry real exposure. Proceedings under Section 7A can determine dues going back years, and interest and damages accrue on top. They are also directed at the employer personally in a way that many statutory notices are not.

What triggers a notice
- Employees not enrolled who should have been covered

The wages dispute
The most common substantive dispute is what counts as wages for provident fund purposes. Employers frequently split remuneration into a low basic wage and a large set of allowances, and compute contributions only on the basic.
The department’s position, supported by judicial authority, is that allowances paid universally and ordinarily to all employees form part of wages for contribution purposes. A structure built to minimise contributions on that basis is likely to be reopened, and the arrears determined over several years at once.
Section 7A proceedings
An inquiry under Section 7A is a quasi-judicial proceeding in which the authority determines the amount due from the establishment. You are entitled to notice, to produce records and to be heard.
The determination is appealable, but the appeal generally requires a pre-deposit of part of the determined amount. That makes the inquiry stage the point at which to contest properly, rather than treating it as a preliminary to a real hearing later.
Interest and damages
- Interest under Section 7Q on delayed contributions, from the due date
- Damages under Section 14B on a graded scale by length of delay
- Both are recoverable from the employer and cannot be deducted from employees
- Damages may be waived only in limited circumstances, commonly involving a sick industrial company
