Professional Tax Registration

Employer and enrolment registration under your state’s professional tax law.

Professional tax is a state levy on income earned by way of profession, trade, calling or employment. In Maharashtra it is charged under the Maharashtra State Tax on Professions, Trades, Callings and Employments Act, 1975, and it is collected by the state rather than the central government.

There are two separate registrations and most businesses need both. PTEC covers the tax the business or professional pays on their own account. PTRC covers the tax an employer deducts from employees’ salaries and pays over to the state.

PTEC and PTRC — the difference matters

  • PTEC — the enrolment certificate, for the entity or professional’s own liability
  • PTRC — the registration certificate, for deducting and remitting employees’ professional tax
  • A proprietor with no employees generally needs only PTEC
  • An employer with salaried staff needs both
  • Companies, LLPs and firms need PTEC even where the directors or partners are separately liable

What has to be filed once registered

The filing frequency for PTRC depends on the tax deducted in the previous year — monthly for larger deductors, annually for smaller ones. PTEC is a yearly payment.

A nil return is still due for a period with no employees or no salary paid. Skipping it is treated as a default.

Frequently asked questions

Do I need both PTEC and PTRC?

If you employ salaried staff, yes. PTEC covers your own liability as an entity or professional; PTRC covers the tax you deduct from employees. A proprietor with no employees usually needs only PTEC.

Is professional tax charged everywhere in India?

No. It is a state levy and not every state imposes it. Maharashtra, Karnataka, West Bengal, Tamil Nadu and Gujarat are among those that do, and the slabs differ between them.

How much is it?

It is charged on a slab basis linked to monthly salary or income, subject to a constitutional ceiling of ₹2,500 per person per year. The slabs are set by each state.

What if I have employees in more than one state?

You need PTRC in each state that levies professional tax and where you have employees, since the obligation and the slabs are state-specific.

Do I file if I paid no salary that month?

Yes. A nil return is still required. Not filing is treated as a default and attracts a late fee.

What is not included. Government fees, statutory charges, stamp duty, court and registry fees, digital signature costs and any third-party professional charges are separate and payable at actuals.
