Provident fund registration brings your establishment within the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952. Once registered, both you and your employees contribute a percentage of wages each month to a retirement fund held in the employee’s name.

Registration becomes compulsory once you employ twenty or more persons. It can also be taken voluntarily below that threshold, which employers often do because it makes the job more attractive and avoids a scramble when headcount crosses the line.

  • The obligation attaches from the date the threshold is crossed, not from the following year
  • Once covered, the establishment stays covered even if headcount later falls

  • Registration must be applied for within one month of becoming liable

How contributions work

The statutory contribution is twelve per cent of basic wages plus dearness allowance from the employee, matched by the employer. The employer’s share is split between the provident fund and the pension scheme.

A wage ceiling applies for mandatory coverage, though an employer may contribute on higher wages by agreement. Administrative charges are payable by the employer on top of the contribution.

Can I register voluntarily with fewer employees?

Yes, with employee consent. Many employers do it early to avoid a disorderly transition later and because it helps in hiring.

What is the contribution rate?

What happens if contributions are paid late?

Interest runs on the delayed amount and damages are levied on a graded scale depending on the length of the delay. Both are recoverable from the employer.

If headcount drops below twenty, does coverage end?

No. Once an establishment is covered it continues to be covered, even if employee numbers later fall below the threshold.
