Structuring salary properly

How a salary is split matters to both sides. Basic pay drives provident fund liability, gratuity and leave encashment. Allowances affect what the employee can claim and what you contribute.

A structure that sets basic pay artificially low to reduce provident fund cost has been challenged repeatedly and creates a contingent liability. We structure salaries to be defensible rather than merely cheap this month.

Full and final settlement

Exits are where payroll disputes concentrate. A settlement has to account for salary to the last working day, leave encashment, notice period recovery or payment, gratuity where five years are complete, and recovery of any advance.

The employee’s provident fund exit must also be filed, without which they cannot withdraw or transfer their balance — a common source of complaints against former employers long after the person has left.

How we handle it

  2. 2 Monthly inputs You send attendance, new joiners, exits and any one-off payments by an agreed cut-off date.
  3. 3 Processing The payroll is run, deductions computed and a register sent to you for approval before anything is paid.
  4. 4 Disbursement The bank transfer file is prepared and payslips issued to employees.
  5. 5 Statutory remittance Provident fund, ESI, professional tax and TDS are remitted within their due dates.
  6. 6 Periodic filings Quarterly TDS returns and annual Form 16 are prepared and filed.

Frequently asked questions

At what headcount does outsourcing make sense?

There is no fixed number, but most businesses find it worthwhile once provident fund and ESI apply, because the filings and the penalty exposure grow faster than the headcount.

Who is liable if a statutory payment is late?

The employer remains liable in law for interest and damages. We work to the deadlines and flag anything at risk, but the statutory liability cannot be contracted away.

Can you handle employees across several states?

Yes. Professional tax slabs and some labour registrations are state-specific, so multi-state payroll needs the registrations in place in each state.

Do employees get their own payslips?

Yes. Payslips are generated each month and distributed to employees directly, and Form 16 is issued annually.

What about gratuity?

Gratuity becomes payable on exit where five years of continuous service are complete. We compute it as part of the full and final settlement.

What is not included. Government fees, statutory charges, stamp duty, court and registry fees, digital signature costs and any third-party professional charges are separate and payable at actuals.
