An apartment owners’ association gives residents a legal identity — the ability to hold a bank account, collect maintenance, enter contracts with vendors, and take a builder or a defaulting member to court in the association’s own name rather than as a group of individuals.

Without registration, an informal committee has no standing. It cannot sue, cannot hold property, and its office bearers are personally exposed on contracts they sign on everyone’s behalf.

Which structure applies in Maharashtra

In Maharashtra the usual route is a co-operative housing society registered under the Maharashtra Co-operative Societies Act, 1960, which is the structure most redevelopment and conveyance work assumes.

Registration as a society under the Societies Registration Act, or as an apartment condominium under the Maharashtra Apartment Ownership Act, are alternatives used in particular circumstances. The right choice depends on how the property was sold and what the agreements say.

The builder’s obligations

  • To form the society within the period the law prescribes after a proportion of flats are sold
  • To convey title in the land and building to the society, known as conveyance
  • To hand over accounts, plans and the corpus collected from purchasers
  • To transfer maintenance deposits held on the members’ behalf
  • Where the builder does not, members may seek deemed conveyance through the competent authority

What the association does once registered

  • Collect maintenance charges and enforce recovery from defaulters
  • Maintain common areas, lifts, water supply and security
  • Hold the general body meeting and elect a managing committee
  • Maintain statutory registers, accounts and minutes
  • File returns and get accounts audited as the Act requires
  • Approve transfers of membership when a flat is sold
  • Represent members in dealings with the builder and local authorities

  4. 4 Name reservation and account The proposed name is reserved and the initial share capital deposited in a bank account.
  5. 5 Filing The application is filed with the Registrar for your district with the member list and supporting documents.
  6. 6 Registration and handover The certificate is issued, after which we can pursue conveyance from the builder where it is outstanding.

Frequently asked questions

Is registering the association compulsory?

The builder is obliged to form the society within the prescribed period once a proportion of flats are sold. Where they have not, members can proceed themselves — and should, because an unregistered committee has no legal standing.

What is deemed conveyance?

Where the builder fails to convey title to the society, members can apply to the competent authority for a conveyance order without the builder’s cooperation. It is a well-used remedy in Maharashtra.

How many members are needed?

A minimum number of flat owners must join as promoters, and the threshold depends on the structure chosen. We confirm the requirement for your building at the outset.

Can the association recover unpaid maintenance?

Yes. A registered society can recover dues through the mechanism the Act provides, and charge interest at the rate set in the bye-laws. An unregistered committee cannot.

What if the builder will not hand over documents?

Registration can generally proceed on the documents members hold. Recovery of plans, accounts and the corpus is then pursued separately, including through deemed conveyance.
