A trademark registration runs for ten years from the date of application and can be renewed indefinitely in further ten-year terms. Renewal is the cheapest intellectual property work you will ever do, and letting it lapse is among the most expensive mistakes.

The registry issues a reminder before expiry, but it goes to the address on record. Businesses that have moved, changed agents or simply stopped watching their post routinely miss it, and discover the lapse only when someone else files for their brand.

The renewal window and what follows it

  • Renewal may be filed within one year before the registration expires
  • A late renewal is possible within six months after expiry, on payment of a surcharge
  • After that the mark may be removed from the register
  • A removed mark can be restored by application within one year of removal, with a further fee
  • Beyond that window the mark is gone and must be applied for afresh, with no guarantee it is still available

What lapsing actually costs you

While a registration is lapsed you lose the statutory rights that come with it — the presumption of validity, the ability to sue for infringement rather than passing off, and the right to use the ® symbol.

The real danger is that a third party files for the same mark in the interval. Your prior use gives you arguments, but you are then fighting from a much weaker position than simply holding a live registration would have given you.

  • Whether the mark is still in use as registered, since non-use for five years exposes it to rectification
  • Whether your business has extended into classes the registration does not cover
  • Whether the mark as used has drifted from the mark as registered

Frequently asked questions

When should I renew?

Any time within the year before expiry. Filing early costs no more and removes the risk of the reminder going astray.

What if I have already missed the date?

A late renewal with surcharge is possible within six months of expiry. After removal, restoration can be sought within a year. Beyond that you must file afresh and may find the mark no longer available.

Does renewal require proof that I am using the mark?

No proof is required to renew. But a mark unused for a continuous five years is vulnerable to rectification by a third party, so use matters even though it is not checked at renewal.

Can I add classes when renewing?

No. Renewal continues the existing registration as it stands. Extending to new classes requires a fresh application for those classes.

How long does the renewed registration last?

A further ten years from the date of expiry of the previous term, and it can be renewed indefinitely thereafter.
