Trademark Registration
Search, class selection and filing to secure exclusive rights over your brand name or logo.
A trademark is what gives you the exclusive right to a brand name, logo or tagline in the class of goods or services you trade in. Registering a company or a domain name gives you no such right — the two are frequently confused, and the confusion is usually discovered when someone else starts trading under your name.
A registration lasts ten years, is renewable indefinitely, and can be enforced against imitators. Once your application is filed you may use the ™ symbol; the ® symbol becomes available only after the mark is registered.

Why the search matters more than the filing
Anyone can file a trademark application. The skill is in knowing beforehand whether it stands a realistic chance, because the government fee is not refunded when an application fails.
We search the register for identical and deceptively similar marks in your class, and assess whether the mark is inherently distinctive. Marks that merely describe the goods, or that are common to the trade, face objections under the absolute grounds and often cannot be salvaged.
Classes, and why picking them matters
Trademarks are registered against classes of goods and services under a forty-five class international system. Protection extends only to the classes you file in.
A restaurant brand filed only in class 43 for restaurant services has no protection over packaged food sold under the same name in class 30. If you plan to extend the brand across categories, it is cheaper to file the additional classes at the outset than to discover the gap later.
The road from filing to registration
- Filing, after which the application number is issued and ™ may be used
- Formality check, followed by examination and an examination report
- Objection reply, where the examiner raises grounds — a very common stage
- A hearing before the registry, if the written reply does not resolve the objection
- Publication in the Trade Marks Journal once accepted
- A four-month opposition window in which any third party may oppose
- Registration and issue of the certificate, if unopposed or if opposition is defeated
How we handle it
- 1 Search and assessment The register is searched for conflicting marks and we give you an honest view of the prospects before any fee is spent.
- 2 Choosing the class The right class or classes are identified for what you actually sell, and for what you plan to sell.
- 3 Filing the application The application is filed with the authorisation form, and the number is issued so you can begin using ™.
- 4 Examination report If objections are raised, we draft and file a reasoned reply within the one month allowed.
- 5 Hearing, if required Where a hearing is fixed, an attorney appears and argues the application through.
- 6 Publication and registration On acceptance the mark is published, and if the opposition window passes unchallenged the certificate is issued.
Frequently asked questions
Does registering my company protect the name?
No. Company registration stops another company being incorporated with an identical name; it gives you no rights against a business using the name as a brand. Only a trademark registration does that.
When can I use the ® symbol?
Only after registration is granted. Using ® on an unregistered mark is a misrepresentation. Between filing and registration you may use ™.
How long does registration last?
Ten years from the date of application, renewable indefinitely in ten-year terms. A missed renewal can lead to removal from the register.
What is the government fee?
It is charged per mark per class, at a concessional rate for individuals, startups and entities holding a Udyam certificate, and a higher rate for others. It is paid to the registry and is separate from our professional fee.
What happens if someone opposes my mark?
You file a counter-statement within two months, then both sides file evidence and the matter is heard. Opposition is a contested proceeding and is charged separately from the filing.
What is not included. Government fees, statutory charges, stamp duty, court and registry fees, digital signature costs and any third-party professional charges are separate and payable at actuals. GST applies on professional fees where indicated. Prices shown are indicative and may change without notice; we confirm the total in writing before any work begins — see our terms on pricing.
