The power of attorney authorising an agent to act for you before the trademark registry.
Form TM-48 is the power of attorney by which you authorise an agent or attorney to act for you before the Trade Marks Registry. Without it on record, the registry will not correspond with your representative or accept filings from them.
It is a short document but it governs the whole relationship with the registry. Filings made without a valid authorisation on record are liable to be objected to, and correspondence goes to the applicant rather than to the person handling the matter.

What it authorises

Why correspondence matters
The registry sends examination reports, hearing notices and other communications to the address for service on record. Where no agent is appointed, that is the applicant’s own address.
Deadlines run from when the communication is made available, not from when it is noticed. An applicant who has moved, changed email, or simply is not watching can lose an application to an unanswered examination report without ever having seen it. Appointing an agent puts a professional in that path.

Changing agents
You are free to change representatives. A fresh TM-48 in favour of the new agent is filed, and the registry updates the address for service.
It is worth confirming that the change has actually been recorded before assuming correspondence will reach the new agent, since a pending change means notices continue going to the previous address.

Frequently asked questions
Do I have to appoint an agent?
No. An applicant may act for themselves. But the registry will then correspond only with you, and deadlines run from when a communication is made available rather than when you notice it.
Does one authorisation cover all my marks?
It can. A single authorisation may cover multiple applications by the same applicant, which is simpler than executing one for each.
Can I change agents?
Yes. A fresh TM-48 in favour of the new agent is filed and the address for service updated. Confirm the change is recorded before assuming correspondence has moved.
Is stamp paper required?
It depends on the state. Where required, the form must be executed on stamp paper of the prescribed value, which is a statutory charge separate from professional fees.
What if my application is refused for non-response?
Deadlines run whether or not the communication was seen. That is precisely the risk an appointed agent removes, by putting a professional in the correspondence path.
What is not included. Government fees, statutory charges, stamp duty, court and registry fees, digital signature costs and any third-party professional charges are separate and payable at actuals.
