Revised & Belated Return Filing

Correct an error in a filed return or submit a late one, within the timelines the Act allows.

A return already filed can be corrected by filing a revised return. It is a normal part of the system rather than an admission of wrongdoing, and there is no penalty simply for revising — the department would rather have the correct figure than the first one.

What matters is the deadline. A revised return can only be filed within the window the Act allows, and once that closes the only remaining route is the updated return, which comes with additional tax attached.

When to revise

Revised, belated and updated returns are different

A revised return corrects a return already filed, within the window the Act allows. A belated return is an original return filed after the due date, which attracts a fee under Section 234F and forfeits the right to carry forward losses.

An updated return under Section 139(8A) is the route once the revision window has closed. It allows reporting of additional income within a longer period, but only on payment of additional tax over and above the normal liability, and it cannot be used to claim a refund or increase one.

The revised return replaces the original

It is not a supplement. The revised return substitutes the original entirely, so the whole return must be completed afresh rather than only the corrected portion.

It must also be verified. An unverified revised return leaves the original standing, which defeats the purpose and is a common oversight.

Revising after a notice

Where the department has already issued a notice about the very item you propose to correct, revising does not undo the notice, though voluntary correction generally helps on penalty.

Where an assessment has been completed for the year, the return can no longer be revised. The remedy at that point is a rectification application or an appeal, depending on what is wrong.

Is there a penalty for revising?

No penalty for the act of revising. Additional tax and interest are payable on any extra income, but voluntary correction is treated far better than the department finding it.

How many times can I revise?

There is no limit within the available window. Each revision replaces the previous one, and the last valid return filed is the one that stands.

Can I revise a belated return?

Yes, a belated return can itself be revised within the window the Act allows.

What if the window has closed?

An updated return under Section 139(8A) may be available over a longer period, but it requires payment of additional tax and cannot be used to claim or increase a refund.

Can I revise after receiving a notice?
