80G Registration
Approval that lets people donating to your organisation claim a deduction on their own returns.
Approval under Section 80G lets a person donating to your organisation claim a deduction on their own income tax return. It is granted to the organisation, but the benefit runs to the donor — which is precisely why it matters for fundraising.
Most corporate CSR budgets, institutional grants and serious individual donors will not release funds to an organisation without 80G approval, because the deduction is part of what makes the donation viable for them.
What this costs
Basic
₹9,404 plus GST
- Application prepared for you
- Application filed with the department
- 80G Registration Number
- 80G Certificate
What the donor actually gets
For most approved institutions the donor deducts fifty per cent of the amount donated, and the deduction is capped by reference to a percentage of their adjusted gross total income.
Certain specified funds carry a hundred per cent deduction, but those are notified funds rather than ordinary charitable organisations. A donation made in cash above the prescribed limit does not qualify at all, so donors should pay by banking channel.
Conditions the organisation must satisfy
- It must hold registration under Section 12A
- Its objects must be charitable and must not be for the benefit of a particular religious community or caste
- It must not carry on a business, unless the business is incidental and separate accounts are maintained
- Its constitution must prohibit transfer of income or assets to members or trustees
- Regular accounts must be maintained and audited where required
- Returns must be filed each year
Form 10BD is now the linchpin
Approval alone no longer secures the donor’s deduction. The organisation must file an annual statement of donations in Form 10BD and issue each donor a certificate in Form 10BE.
A donation that does not appear in the organisation’s Form 10BD cannot be claimed by the donor, because the department matches the claim against the statement. An organisation that fails to file it will find its donors do not return.
How we handle it
- 1 Confirming 12A is in place Approval under 80G presupposes Section 12A registration, so we confirm or apply for it first.
- 2 Reviewing the constitution The objects and the non-distribution and dissolution clauses are checked against the conditions in Section 80G.
- 3 Assembling the activity record Accounts and evidence of charitable work are compiled for the application.
- 4 Filing The application is filed in the prescribed form with the supporting documents.
- 5 Answering queries Written queries from the Commissioner are responded to within the time allowed.
- 6 Setting up donor reporting On approval we set up the Form 10BD and 10BE process, without which donors cannot claim.
Frequently asked questions
Can I get 80G without 12A?
No. Section 12A registration is a precondition. Most organisations apply for both together to avoid duplicating the document set.
How much can my donors deduct?
For most approved institutions, fifty per cent of the donation, subject to a ceiling linked to the donor’s income. A hundred per cent deduction applies only to specified notified funds.
Do donors need anything from us?
Yes. You must file Form 10BD annually reporting every donation and issue each donor a Form 10BE certificate. Without appearing in your 10BD, a donor cannot claim the deduction.
Can a religious trust get 80G?
An organisation whose objects are for the benefit of a particular religious community or caste is generally excluded. Trusts with genuinely charitable objects open to all may qualify.
Does approval expire?
Yes. Approvals are granted for a fixed period and must be renewed before expiry, in the same way as 12A registration.
